Yesterday I was delighted to hear on the radio that Munir Hussain had had his prison term suspended by an appeal judge who recognised the extreme circumstances and public outcry following his story. His brother Tokeer received a reduction in his sentence to 2 years and remains in jail.
In a case that bore some resemblance to the Tony Martin case, the Hussain brothers were tied up with their family in their house by knife wielding burglars who said they would slit their throats, but turned the tables and used weapons such as a cricket bat and a hockey stick to leave their 57 year old captor, Walid Salem, in hospital with a broken jaw, fractured skull and brain damage.
Salem has a criminal career of 50 recorded offences across a 20 year period yet our ridiculously out of touch judicial system allowed him to walk free from court as the Hussain brothers were sent down for GBH.

Whilst I applaud the judge for suspending the prison sentence, he should have quashed the sentence completely and removed the convictions of both Hussain brothers. It’s an absolute disgrace that the law can even consider putting these guys in prison. Lawmakers should be ashamed that this can happen.
They’re model citizens, yet because of a career criminal and our biased, unfair so-called justice system they find themselves punished beyond imagination for a situation that was imposed upon them by someone who is still at large.
The Conservatives have promised to overhaul the law and possibly implement a Castle Doctrine. I am fully in support of this if they have the balls to convert it from electioneering to legislation.

I am delighted that Mr Hussain has been released although annoyed his sentence was not quashed as he did no wrong as far as I am concerned. Richard Madeley was on Question Time the other night talking about this and make some excellent points. Like Mr Madeley said when you come down at 2 in the morning confronted by a burglar who is possibly armed and could hard you or your family you grab the nearest implement and chase them off or do what you need to, to protect yourself. You don’t stand there thinking what should I do to make sure the British injustice system doesn’t jail me. I think we should adopt a similar system to America where you can defend your property and yourself by any means necessary. The police need to exercise common sense also. Mr Hussain’s ‘victim’ is in fact now so ‘brain damaged’ he has gone on another crime spree since the ‘attack’. You did the right thing Mr Hussain. It should be pointed out though that Patrick Mercer a Conservative MP tabled a Private Members Bill on Householder Protection and it got no interest from MPs. Labour has done nothing on this issue and I don’t trust anything a Labour MP says. Only a new Government will resolve this problem. LABOUR OUT 2010!!!!
